These Terms govern the use of the User-QR service (website uqr.kz, hereinafter the “Service”) between the Service operator (“we”) and the user — the owner or representative of a venue (the “Venue”). By registering with the Service you accept these Terms and the Privacy Policy.
1. Definitions
Service — the platform for creating and publishing a digital QR menu, taking orders from the table and for delivery, a Taplink-style venue page and booking. Account — the Venue's account in the admin panel. Guest — a visitor who opens the Venue's menu via a QR code. Plan — the set of features and limits available for a subscription.
2. Subject
We give the Venue access to the Service on the terms of the chosen plan. The Service is provided “as is”; we make reasonable efforts to keep it running without interruption but do not guarantee the absence of downtime caused by maintenance, updates or circumstances beyond our control.
3. Registration and account
Registration requires a name, a phone number and the Venue name. The phone number is used as the login. You undertake to provide accurate data, keep the password secret and not to share access with third parties other than staff to whom you have assigned roles in the admin panel. One account corresponds to one Venue. You are responsible for all actions performed under your account.
4. Plans, trial and payment
Current plans: Starter — 150 000 ₸ per year (up to 100 menu items, 10 tables) and Pro — 180 000 ₸ per year (unlimited items, up to 100 tables, delivery page, Taplink page, booking, Meta Pixel). Registration includes 14 days of the Pro plan free with no card or prepayment. Payment is made via Kaspi for the chosen period; closing documents for sole proprietors and companies are provided on request.
Prices on the site are valid as of the publication date and may change for new periods; a paid period keeps its price. When the paid period ends, Guest access to the menu and the Taplink page is paused until renewal; the Venue's data is kept. No refund is made for the unused part of a period unless required by the law of the Republic of Kazakhstan.
5. Venue content
The menu, photos, descriptions, prices, opening hours and other materials are uploaded by the Venue. The Venue warrants that it holds the rights to this content and that information about dishes, prices and ingredients is accurate and complies with the law, including the requirements for the language of visual information (Article 21 of the Law of the Republic of Kazakhstan “On Languages”) and consumer information. The Venue grants us a non-exclusive licence to host the content in the Service in order to show it to Guests. Content that violates the law or third-party rights is prohibited.
6. Guests and orders
Guests use the menu without registration. An order placed by a Guest through the Service is a request to the Venue; confirmation, preparation, delivery and settlement with the Guest are the Venue's responsibility. We are not a party to the transaction between the Venue and the Guest and are not liable for the quality of the Venue's food and services.
7. Restrictions
It is prohibited to use the Service to send spam, mislead Guests, attempt unauthorised access to other venues' data, automatically harvest Service data, circumvent plan limits, or decompile or copy the Service's software.
8. Intellectual property
The software, design, the User-QR trademark and documentation belong to the Service operator. Menu pages may display a note that the menu was created on User-QR. Venue content remains the property of the Venue.
9. Availability and support
We may carry out scheduled maintenance with short downtime and try to do so at hours of lowest load. Backups are made regularly. Support is provided via WhatsApp +7 701 027 3772 in Kazakh, Russian and English.
10. Liability
Our liability to the Venue for any claim related to the Service is limited to the amount the Venue paid for the current paid period. We are not liable for lost profit, indirect losses, or interruptions caused by third parties (telecom operators, hosting, payment and messenger services) or force majeure.
11. Personal data
Processing of personal data is described in the Privacy Policy. The Venue is independently responsible for the lawfulness of processing Guest data it collects through its menu, orders, booking and feedback.
12. Termination
The Venue may stop using the Service at any time and request deletion of the account. We may suspend or terminate access in case of breach of these Terms, non-payment of the subscription or when required by law, notifying the Venue via its contact number. On request we provide an export of the Venue's menu within a reasonable time after termination.
13. Changes to these Terms
We may amend these Terms; the new version is published on this page with an update date. Continued use of the Service after publication constitutes acceptance of the changes. We additionally notify Venues of material changes.
14. Governing law and disputes
These Terms are governed by the law of the Republic of Kazakhstan. Disputes are resolved by negotiation; failing agreement, in court in accordance with the law of the Republic of Kazakhstan.
